Under (EC) Regulation 261/2004 air passengers are entitled to compensation of 125 € to 600 € per passenger (irrespective of the ticket price paid) in the event of a
 

  • Cancellation,
  • Delay or
  • Overbooking


that could not have been avoided by the airline. The level of compensation that you may be entitled to is determined by the distance of the flight and the departure and arrival times of potential replacement flights.


Notwithstanding the rules on compensation established in (EC) Regulation 261/2004, the experience is that airlines often reject passengers’ claim requests.
By doing so, they deny passengers the compensation they are entitled to for unsubstantial reasons.


Most passengers lack the knowledge and experience to enforce their claim, in particular when it comes to the circumstances of the cancellation/delay. As a result, they are not in a position to investigate cases where airlines raise a defence of “extraordinary circumstances” or “reasonable measures”.
Surveys indicate that consumers would be quite ready to defend their rights in court if they could join together with other consumers.
